CODE OF ETHICS
AND
COMPLIANCE AND SELF-ENFORCEMENT PROGRAM

PREAMBLE

This Code expresses in general terms the level of professional conduct expected of members of the Michigan Pay Telephone Association, Inc.

Such Code is no guarantee of ethical actions on the part of the members, but depends upon the integrity of each individual member to conduct himself or herself in a responsible and straightforward manner, both in dealings with clients and other professionals.

A profession should be more than a group of individuals offering products and service to the public. It should be an entity with a bond between members based on mutual respect and a dedication to improving the quality of life for all persons.

I. The member shall strive to provide a level of service that exceeds industry standards.

II. The member shall serve the client with integrity, understanding, knowledge, and creative ability, and shall respond ethically to social, political, economic and technological influences.

III. The member shall encourage educational research and the development and dissemination of useful technical information relating to the advancement of the industry.

IV. The member shall strive at all times to abide by the rules and regulations governing operation of payphones.

V. The member shall seek, through cooperative efforts, the elimination of unfair or improper business methods in the industry.

VI. The member shall not make exaggerated, misleading, deceptive or false statements or claims to the public about his/her products, qualifications, experience or performance.

VII. The member shall recognize the qualifications of other Association members and shall not knowingly make false statements about their professional work or products, nor maliciously injure or attempt to injure the business of a fellow Association member, or the business relationship a fellow Association member has with his/her clients.

VIII. The member shall not repair, replace or remove any equipment of another Pay Phone Provider under any circumstances, prior to contacting that member.


COMPLIANCE


Any payphone operator violating the Michigan Public Service Commission and FCC Rules and regulations governing private payphones is endangering the favorable operation of our industry. Any payphones found to be in violation of the Rules and Regulations established by the Michigan Public Service Commission and FCC Rules and Regulations will be reported to the Compliance Committee of the Michigan Pay Telephone Association. The Association will process reports of violation in accordance with the following procedure.

(1) The Committee will maintain a record for each payphone reported to be in violation, to include the following information:

  • Payphone phone number and location

  • Payphone operator name and contact phone number

  • Violation Description

(2) The Committee will notify the payphone operator in writing of the "reported rules violation". The operator will have five (5) business days to correct any problems and reply in writing that compliance has been satisfied.

(3) The payphone in question will be checked for compliance by the Committee after notice is received from the operator.

(4) If a member of the Association fails to correct violations after a notice from the Committee that they are not in compliance, the membership status of that member will be suspended in accordance with the bylaws of the Association.

In addition to individual member commitment to abide by Michigan Public Service Commission and FCC Rules and Regulations, the Association will monitor private payphone companies through its members on a continuing basis. The Association will monitor 100 percent of all private payphone companies, and will compile a monthly violation list by category to be reviewed quarterly. The Association will report the results of the survey to the Michigan Public Service Commission, on a periodic basis mutually acceptable to the Association and to the Michigan Public Service Commission, under a non-disclosure and protection agreement. The report to the Michigan Public Service Commission and FCC Rules and Regulations will specify:

  1. The number of payphones inspected.

  2. The number of payphones not in compliance (by category of violation) but corrected after one notice.

As a member of the Michigan Pay Telephone Association, I pledge to abide by the Michigan Public Service Commission and FCC Rules and Regulations and to uphold the Association Code of Ethics as outlined above.
