    As for the current status of the case, the Commission entered its Order on Remand on March 16, 2004, which held that both Verizon and SBC have unlawful tariffs in place to the extent that they fail to account for the EUCL/SLC charge in their monthly payphone access line rates.  The Commission held that any excessive payments the Complainants made for these unlawful monthly payphone access line rates must be refunded back to April 15, 1997 to each Complainant.  SBC and Verizon were ordered to file refund calculation reports detailing how much is owed each Complainant.  The Commission declined to specifically apply the New Services Test to usage sensitive services.
     
    The Complainants timely filed an Application for Rehearing on, inter alia, the usage issue.  On the same day, SBC filed its Notice of Appeal with the Michigan Court of Appeals.  The Complainants filed their Notice of Cross Appeal, but asked the Court of Appeals to stay the appeal and give the Commission the opportunity to act on the Application for Rehearing.  The Court of Appeals entered an order generally staying the appeal pending the Commission's determinations related to the Complainants' Application for Rehearing. 
     
    Currently, the matter is sitting before the Commission to act on the Application for Rehearing.

MPTA Press Release on SBC's local rate increase on payphones to 50 cents.

Michigan Pay Telephone Association (MPTA) was originally established in
1985 as a non-profit 501(c)(6) trade association in an effort to unite independent 
pay telephone industry operators in Michigan. With its full-time staff, MPTA provides legislative and regulatory representation for approximately 90 payphone providers and over 25 suppliers to the payphone industry. The goals of the association are to improve economic opportunities for all legitimate Independent Payphone Providers and to promote an environment in which all IPPs are able to compete fairly and efficiently. MPTA is one of the oldest and most active pay telephone associations in the country, and also works closely with the American Public Communications Council (APCC).

Recent MPTA Accomplishments include:

  • Deregulated local and zone coin calls in Michigan

  • Preemption of private property municipal ordinances

  • Per-call compensation for Michigan intrastate access code and 
    subscriber calls

  • Exemption from state use tax

  • Exemption from 911 emergency service fees

  • Michigan is the only state that prohibits municipal payphone ordinances 
    on private property
